GENERAL TERMS AND CONDITIONS

FOR PAUL KADJO ONLINE SHOP




1. Scope of Application
1.1 These General Terms and Conditions (GTC) apply to all business relations between the customer and PAUL KADJO, Eimsbütteler Marktplatz 12A, 20257 Hamburg, Germany. These terms apply in the version valid at the time of order placement.

2. Contracting Parties, Conclusion of Contract
2.1 The contract is concluded with PAUL KADJO.
2.2 The presentation and advertising of items in our online shop does not constitute a binding offer. A contract is only formed when PAUL KADJO confirms the customer’s order in writing. Automatic order receipt does not constitute a contract.
2.3 Custom-made goods are produced based on individual specifications and cannot be returned unless defective.

3. Ownership of Website and Intellectual Property Rights
3.1 All content, graphics, and designs on the PAUL KADJO website are protected by copyright. Unauthorized reproduction, distribution, or use of this material is prohibited. PAUL KADJO retains all rights unless expressly granted in writing.

4. Goods and Return Policy
4.1 Goods offered include unique, artistic pieces such as dresses, suits, and other clothing items, as well as banana silk yarn and accessories. These are unique artworks and may change in appearance with use and care.
4.2 Goods may only be exchanged for a voucher equal to the value of the item (excluding duties or shipping), which are non-refundable. No cash refunds are offered due to the custom nature of our products.

5. Services and Membership Terms
5.1 “Insider Access” - Small Membership: Members gain early previews, pre-order opportunities, event invites and free delivery on all orders made through www.paulkadjo.com. By purchasing a membership, the customer agrees to receive such communications.
5.2 "Change Agent" - Medium Membership: Includes everything from “Insider Access” - Small Membership. On top this art of Membership offers product care advice, a lifelong repair service for certain damages on PAUL KADJO items only (excluding damage from external factors), and a Product Renewal Program that allows members to submit old clothes in exchange for vouchers, subject to PAUL KADJO’s approval. The member agrees that PAUL KADJO provides recommended advice on the care of goods, which cannot be held liable against PAUL KADJO in the event of damage to the goods. When requesting repairs, damage must be clearly proven by the member with photos and a brief description. Damage that generally occurs through the use or aging of goods, such as color changes, material wear or similar, is not covered and is considered "signs of use". After PAUL KADJO has confirmed the damage, the member is asked to send the goods in for repair (business address) and to provide an address for return. The member is responsible for shipping to the business office. Shipping after repairs is carried out by PAUL KADJO. PAUL KADJO assumes no responsibility for loss or damage during transport by third parties when customers send the goods for repair. Due to the high individuality of the goods in the upcycling production process, damaged goods are only repaired to the condition before the damage if possible. If this is not possible, the member automatically agrees that the repair will be carried out to the extent that the PAUL KADJO designer considers sensible and feasible.
5.3 "Eco Stylist” - Large Membership: Includes everything from “Change Agent” - Medium Membership. On top this art of Membership includes a one-on-one virtual styling session of 4 hours per quarter (3 months) with curated green fashion tips. This offer is advisory only; PAUL KADJO is not liable for specific outcomes. Results or success of the consulting service are not guaranteed, and no claims can be made to specific consulting results. The scope of this service does not include the adjustment or production of a product. Individual offers are made for individual adjustments or custom-made products, which must be confirmed in writing or by email and then - unless otherwise stated - paid in full. The same applies to additional hours of advice that would exceed the maximum number of hours concerning this service. The member agrees to provide PAUL KADJO with the information necessary to create this service. The information is always treated confidentially. By purchasing a membership, members agree to receive such services, and to receive a surprise item each month from PAUL KADJO.

6. Payment Terms
6.1 Payment is due upon conclusion of the contract and need to be placed through Patreon.com. In the event of a membership cancellation, a voucher equal to the membership fee may be issued.

7. Limitation of Liability and Disclaimer
7.1 Due to the unique and handcrafted nature of the items, the customer accepts that the items may vary in color, material, and form over time. PAUL KADJO is not liable for these changes or for any damages arising from the use of its goods and services. By purchasing, the customer assumes all responsibility for their ownership and upkeep.
7.2 Services provided are advisory and non-binding. PAUL KADJO is not liable for the customer’s application of styling or sustainable fashion guidance.
7.3 PAUL KADJO is only liable for grossly negligent or intentional breaches of its duties.

8. Termination of Contract
8.1 Customers may cancel goods orders within 24 hours of order confirmation. Custom-made items are excluded from return, except in cases of defect.

9. Amendments to Terms
Changes to the Terms and Conditions are only valid for future contracts. Customers will be informed of significant changes, which will apply to future orders.

10. Governing Law
10.1 Contracts are governed by German law, with consumer protection laws in the customer’s home country remaining applicable.

11. Alternative Dispute Resolution
11.1 The European Commission provides a platform for Online Dispute Resolution at https://ec.europa.eu/consumers/odr/. PAUL KADJO does not participate in formal dispute resolution with consumer bodies. PAUL KADJO endeavours to resolve potential disputes directly with customers.

12. Retention of Title
12.1 Ownership of goods remains with PAUL KADJO until full payment is made.

13. Severability Clause
13.1 If any provision of these GTC is invalid, the validity of the remaining provisions remains unaffected.

These documents are advisory only; PAUL KADJO is not liable for specific outcomes. Results or success of the consulting services are not guaranteed, and no claims can be made to specific consulting results. The scope of the "VIRTUAL STYLING SUPPORT" service is limited to a maximum of 4 hours of advice per 30 days and does not include the adjustment or production of a product. Individual offers are made for individual adjustments or custom-made products, which must be confirmed in writing or by email and then - unless otherwise stated - paid in full. The same applies to additional hours of advice that would exceed the maximum number of hours. As part of the "BUILD YOUR PERSONAL STYLE" service, PAUL KADJO will share a document in PDF format with the member every 30 days, which sets out the key points for achieving a personal style. The member agrees to provide PAUL KADJO with the information necessary to create this document. The information is always treated confidentially. The "CURATED GREEN FASHION TIPS" service includes a maximum of 2 hours of advice per 30 days and offers a closer understanding and discovery of sustainable fashion. By purchasing a membership, the customer agrees to receive such services.
5.3
Sustainability Services: Membership offers product care advice, a lifelong repair service for certain damages on PAUL KADJO items only (excluding damage from external factors), and custom tailoring options. The scope of the service “CUSTOM TAILORING OPTIONS” is limited to a consultation of 2 hours per 30 days and does not include adjustment or production. Individual offers are made for individual adjustments or custom-made products, which must be confirmed in writing or by email and then - unless otherwise stated - paid in full. A Product Renewal Program allows members to submit old clothes in exchange for vouchers, subject to PAUL KADJO’s approval. The member agrees that PAUL KADJO provides recommended advice on the care of goods, which cannot be held liable against PAUL KADJO in the event of damage to the goods. Budget Flexibility: Members with an annual membership may pause their contract for up to 3 months by giving 30 days’ notice. Monthly memberships are automatically terminated after 30 days unless renewed.


6. Payment Terms
6.1 Payment is due upon conclusion of the contract. In the event of a membership cancellation, a voucher equal to the membership fee may be issued. Renewals require a new purchase through the online shop.


7. Limitation of Liability and Disclaimer

8. Termination of Contract
8.1 Customers may cancel goods orders within 24 hours of order confirmation. Custom-made items are excluded from return, except in cases of defect. Memberships may be terminated on a monthly basis or paused annually as per Section 5.4.


9. Amendments to Terms
9.1 Changes to the Terms and Conditions are only valid for future contracts. Customers will be informed of significant changes, which will apply to future orders.


10. Governing Law
10.1 Contracts are governed by German law, with consumer protection laws in the customer’s home country remaining applicable.
